Sample ordinance for adopting the State Fire Code

The Minnesota State Fire Code, as adopted pursuant to Minnesota Statutes, section 299F.011, and as modified by Minnesota Rules, Chapter 7511, shall be applicable within the City of <insert city name>.

Section 1. Definitions

  1. Wherever the word 'jurisdiction" is used in the Minnesota State Fire Code, it shall mean the City of <insert city name>.
  2. Whenever the term 'this code" is used in the Minnesota State Fire Code or this ordinance, it shall mean the code adopted pursuant to this ordinance.

Section 2. Enforcement

  1. The chief of the fire department <or designate other representatives if it is not the fire department who enforces the fire code> is authorized to enforce the provisions of the Minnesota State Fire Code and this ordinance.
  2. The chief of the fire department <or designate other representatives if it is not the fire department who enforces the fire code> may detail such members of the fire department <or designate other representatives if it is not the fire department who enforces the fire code> as may be necessary to administer and enforce the provisions of this ordinance.

Section 3. Amendments to the Minnesota State Fire Code

<Add regulations or amendments to the state fire code. These amendments must be equal to, in addition to, or more restrictive than the state fire code but cannot exceed the state building code (see Minn. Stat. § 299F.011, subd. 4). Examples of amendments include prohibition of barbecues on apartment balconies, designation of areas for aboveground flammable liquid tanks, designation of areas for LP-gas storage, and the establishment of fire lanes on public and private land with the related authority to issue citations or authorize the towing / removal of vehicles parked in fire lanes>.

Section 4. Permits

<Add language as to what type of permits are required by the jurisdiction. Examples would include permits for the installation or maintenance of fire protection systems (sprinkler, standpipe, and fire alarm systems), fireworks sales, fireworks displays, or similar hazardous operations>.

Section 5. Penalties

A person who violates the provisions of the Minnesota State Fire Code or this ordinance after being given written notice shall be guilty of a misdemeanor. Each day’s violation after notice thereof shall constitute a separate offense.

Section 6. Appeals

<Some cities like to include a section on appeals. It is not mandatory that specific language be adopted as appeal procedures are established in Minn. Stat. § 299F.011, subds. 5, 5a, 5b, and 6>.
